Otherwise, courts have the power to make parenting orders, on the application of either parent, a child’s carer, or the child itself. Although the primary consideration is the best interests of the child, the court will make its decision based on a wide variety of factors, such as the child’s relationship with each parent, parental attitudes, and capacity to provide.
Once an order is in force, a breach may constitute abduction. The court can issue a warrant for the child’s recovery or the offender’s arrest.
On occasions, there is a need to move very urgently, for example, to prevent a child being taken from the country. Watson & Watson has undertaken such applications and recently obtained a judgment within 2 hours, preventing a child leaving the country, such an order being obtained close to 9 pm at night.
