Strata Legislation

The Strata Schemes Management Act sets out the rights and responsibilities of an Owners Corporation, and of any individual owners and occupiers within the Strata Scheme, while The Strata Schemes (Freehold Development) Act lays out the law in relation to the system of ownership within a Strata Scheme.

Building Disputes

Building work done within a Strata Scheme can be begun by the Owners Corporation or individual property owners commissioning building work within their own unit (which requires the permission of the Owners Corporation). Any disputes between builders and those retaining them can, on occasion, require the specialist expertise of a building and construction lawyer.

Defective Building Works

If a builder or tradesman responsible for defective work refuses to fix the issue within the appropriate period, there are legal avenues that you can pursue. Action can be undertaken by individual strata title owners or the Owners Corporation to seek remedy of defective building work or related damages.

Owners Corporation Regulations

Upon buying strata title property, you will automatically become a member of the Owners Corporation (sometimes also called Body Corporate). The Owners Corporation has regulations, or ‘by-laws’, which owners and occupiers must follow. These by-laws can relate to things like the behaviour of residents and the use of common property, and are enforceable by law.
